At one time or another in our lives, we might have taken out a loan or a debt. The factors that prompt us to repay it vary from protecting our integrity, avoiding a bad a credit report, but probably most importantly, it is the fear of harassment from the creditor.
Many times when a debt does not get paid on time the creditor company will have a department responsible for collecting that debt. Or they will pass it on to a third party for collection. Debt collectors usually employ techniques that amount to gentle persuasion, verbal arm twisting, or subtle threats to get debtors to pay up. Sometimes the collector resorts to illegal means to collect what they are owed and harassment is one of the main weapons they use.
In fact, debt collection techniques that are considered outright debt collection harassment have been made illegal under the US FDCPA – Fair Debt Collection Practices Act. But, still there are some debt collectors who continue to use harassment for collection. They can often get away with this because consumers are unaware of the protection they have under the law.
Unscrupulous debt collectors play on the good conscience of people who owe money. The vast majority of people want to repay their debts. Debt collectors employ techniques that work, and often the most effective techniques involve threatening and cajoling people. They are usually third parties who have only one objective: to get the money you owe, and they can be quite ruthless in their attempts to get it.
The FDCPA is quite explicit in making specific debt collection techniques illegal. Abusive language is one of them, as well as communicating with third parties in the effort to collect.
